Terms of Service

The agreement between you and Ultimate CueSports Overlays. It is deliberately short and in plain English, because terms nobody reads protect nobody.

Read this one part if you read nothing else. This software is in active development. It records live matches that cannot be played again. Do not rely on it as your only recording of something you cannot afford to lose — run a second capture for anything that matters.

What this is

Ultimate CueSports Overlays provides broadcast scoreboard graphics for cue sports. You operate a control panel in one browser window; a second window renders the overlay, which you either record to a file or feed into streaming software.

The service is currently free to use and we are not taking payments. Any pricing shown elsewhere on the site is illustrative and nothing is charged. If we ever begin charging, it will be with clear notice and never applied retrospectively.

Your account

Your content

Your recordings and designs are yours. We claim no ownership of anything you make, and no licence to use it. Your recordings never reach our servers at all — they are produced and saved entirely on your own machine.

We store your saved designs so we can give them back to you on any device you sign in from. That is the only thing we do with them.

You are responsible for what you put into a design. If you upload a logo or type a name, you need the right to use it — a club badge or a sponsor's mark generally belongs to someone else.

Acceptable use

Do not use the service to break the law, to harass anyone, to impersonate someone, or to display content that is abusive or unlawful. Do not attempt to break into other people's accounts, disrupt the service for others, or use automated means to hammer it.

We may suspend or remove an account that does these things. For anything ambiguous we will get in touch before acting.

Reliability, honestly stated

This software is under active development and is provided as it is. We track known failure modes carefully and fix them deliberately, but recording live video in a browser depends on your machine, your camera or capture device, your available memory and disk, and your network. Any of those can fail in ways we cannot control or always detect.

For anything that genuinely matters — a final, a tournament, a match that cannot be replayed — run an independent second recording. We would rather tell you that plainly than have you discover it at a venue.

Warranties and liability

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any lost recordings, lost footage, lost profits, lost opportunities or lost data arising from your use of the service. Because the service is provided free of charge, our total liability to you is limited to zero, or to the amount you have actually paid us, whichever is greater.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else which cannot lawfully be excluded.

Changes and ending

We may update these terms as the product develops; the date at the top will change and material changes will be emailed to account holders. You can stop using the service at any time. We may suspend or end access if these terms are broken, or if we discontinue the service — in which case we will give account holders reasonable notice and a chance to retrieve their designs.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where the law of your own country gives you rights that cannot be excluded.
